Chester County Court of Common Pleas DUI Cases

The Chester County Court of Common Pleas is the 15th Judicial District and serves Chester County exclusively. DUI cases begin in Magisterial District Courts for preliminary hearings and then move to Common Pleas for formal arraignment, pretrial motions, and trial if needed. Misdemeanor DUI offenses handled at the Common Pleas level include second offenses with higher BAC readings. Felony DUI cases arise under 75 Pa.C.S. § 3804 when a defendant has a third or subsequent offense, or when a DUI crash causes serious injury or death under 18 Pa.C.S. § 3735.

Pennsylvania uses three tiers for DUI offenses based on blood alcohol content. General impairment covers BAC between 0.08 and 0.099 percent. High BAC runs from 0.10 to 0.159 percent. Highest BAC is 0.16 percent and above. Each tier carries increasing penalties under 75 Pa.C.S. § 3804, and prior offenses tracked under 75 Pa.C.S. § 3806 can raise the level of the offense. The Chester County District Attorney at chesco.org/district-attorney handles prosecution of all DUI cases in the county. The office works with the West Chester Police and the Chester County Sheriff to investigate and charge impaired drivers.

ARD Program in Chester County

The Accelerated Rehabilitative Disposition program, governed by 75 Pa.C.S. § 3807, is available for first-time DUI offenders in Chester County. ARD allows eligible defendants to complete a period of supervision, pay fines, attend DUI school, and possibly complete community service in exchange for having their charges dismissed. No conviction goes on the record if the person completes all requirements. Many people pursue ARD because it avoids a criminal conviction and may allow for expungement afterward.

The Chester County District Attorney reviews each ARD application on its own facts. Factors include the person's BAC level, whether there was an accident, whether anyone was injured, and whether the applicant has any prior criminal history. Applicants with a BAC in the highest tier or with aggravating circumstances may not qualify. The chemical testing requirement under 75 Pa.C.S. § 3814 applies to all DUI cases and is a factor the DA reviews in ARD decisions.

Note: Completing ARD in Chester County does not mean the arrest record disappears automatically. You must petition the court separately for expungement after successful program completion.
